Welcome to Ask ADR. These Terms of Service ("Terms") govern your access to and use of the Ask ADR services, including our website, mobile application (the "App"), and any related platforms provided by Zeroth Group Pty Ltd (ABN 81 665 998 443), trading as Ask ADR ("we," "our," or "us").

By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our services.

1. Description of Service

Ask ADR is an AI-powered reference application that provides access to Australian vehicle modification and compliance documents, including Australian Design Rules (ADRs), National Codes of Practice (NCOPs), Vehicle Standards Bulletins (VSBs), administrator circulars, and related standards.

Free consumer-facing services: We offer free services on our website, including vehicle lookups, AI-powered modification guidance, and a directory to help you find qualified vehicle engineers. At the end of the Mod Check flow, you may choose one of two options:

  • Browse & select an engineer: You choose a specific engineer from our directory and we send your enquiry (contact details, vehicle information, and modification details) directly to them as a lead.
  • Request an engineer contact you: You leave your contact details and we will facilitate a connection with a qualified engineer on your behalf. Your information (contact details, vehicle information, and modification details) may be shared with one or more engineers so they can reach out to you.

We record which option you chose so we can serve you appropriately. In both cases, engineers listed in our directory are independent third parties and we are not responsible for their conduct once they receive your information.

Vehicle Lookup (Pro feature): Ask ADR Pro includes a Vehicle Lookup feature powered by MotorWeb. By entering a vehicle registration number and state, vehicle details (including VIN, make, model, year, colour, dimensions, mass, towing capacities, and other specifications) are retrieved from MotorWeb's database and displayed in the app. This data is provided for convenience and reference purposes. You should verify the accuracy of all vehicle data independently. We are not responsible for the accuracy, completeness, or currency of data sourced from MotorWeb.

The service uses artificial intelligence to help users search and query these documents. Ask ADR is intended as a reference tool and does not provide legal, engineering, or professional advice.

2. Eligibility

You must be at least 13 years of age to use our services. By using our services, you represent and warrant that you meet this eligibility requirement.

3. User Accounts

3.1 Account Creation

To access certain features of our services, you may need to create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account.

4. Acceptable Use

You agree not to:

  • Use our services for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorised access to our services or their systems
  • Interfere with or disrupt our services or servers connected to them
  • Transmit any malware, viruses, or other harmful code
  • Use our services to harass, abuse, or harm others
  • Reproduce, duplicate, copy, sell, or resell any portion of our services
  • Use automated means to access our services without our express permission
  • Misrepresent your identity or affiliation with any person or organisation

5. Intellectual Property

5.1 Our Content

Our services, including their design, features, and content created by us, are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our content without our express written permission.

5.2 Third-Party Content

Our services provide access to Australian government documents and standards. These materials are subject to their own copyright and usage terms. We do not claim ownership of government-published materials.

Vehicle data retrieved through the Vehicle Lookup feature is sourced from MotorWeb and is subject to MotorWeb's own terms, conditions, and accuracy limitations. We do not guarantee the accuracy, completeness, or currency of vehicle data provided by MotorWeb and accept no liability for errors or omissions in that data.

5.3 Your Content

You retain ownership of any content you submit through the App. By submitting content, you grant us a non-exclusive, worldwide, royalty-free licence to use, process, and store such content for the purpose of providing our services.

6. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IMPORTANT:

The information provided through our services is for general reference purposes only. It should not be relied upon as a substitute for professional advice from qualified vehicle engineers, certifiers, or legal professionals. Always verify information with official sources and consult appropriate professionals before making decisions based on our services' content.

We do not warrant that:

  • Our services will be uninterrupted, secure, or error-free
  • The results obtained from our services will be accurate or reliable
  • Any errors in our services will be corrected

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ZEROTH GROUP PTY LTD (TRADING AS ASK ADR), ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of (or inability to access or use) our services
  • Any conduct or content of any third party on our services
  • Any content obtained from our services
  • Unauthorised access, use, or alteration of your transmissions or content

8. Indemnification

You agree to indemnify, defend, and hold harmless Zeroth Group Pty Ltd (trading as Ask ADR) and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of our services or your violation of these Terms.

9. Subscription and Payments

9.1 Subscription Services

Certain features of our services may require a paid subscription. Subscription fees and terms will be clearly displayed before purchase.

9.2 Payment Processing

Payments are processed through the Apple App Store or Google Play Store. All payments are subject to the terms and conditions of the respective platform.

9.3 Refunds

Refund requests are handled in accordance with the policies of the Apple App Store or Google Play Store through which you purchased the subscription.

10. Termination

We may terminate or suspend your account and access to our services at our sole discretion, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use our services will immediately cease.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Effective Date" above. Your continued use of our services after any such changes constitutes your acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions.

13. Dispute Resolution

Any disputes arising out of or relating to these Terms or our services shall first be attempted to be resolved through good-faith negotiation. If negotiation is unsuccessful, disputes shall be resolved through binding arbitration in accordance with Australian law.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Zeroth Group Pty Ltd (trading as Ask ADR) regarding your use of our services.
